Petition filed in Supreme Court regarding powers of Chief Justice of High Court

New Delhi: Can the Chief Justice of a High Court or the Acting Chief Justice overdo his administrative seniority rights with appellate i.e. judicial rights? Can you refer the matter being heard in a bench to another bench overnight for hearing without any concrete reason? A petition has come to the Supreme Court seeking answers to these questions.

The petition has been filed by the Calcutta High Court administration in the Supreme Court. There is a lot of commotion in the Calcutta High Court over this issue. The High Court Bar Association has boycotted the Chief Justice Court. The Calcutta High Court has filed an SLP in the apex court to decide the administrative role of the Chief Justice and the Acting Chief Justice. The high court administration in its petition has appealed to the Supreme Court to frame a detailed guideline.

The petition, which challenged an order by Justice Sabyasachi Bhattacharya, said that the status of all judges of the court is equal, but the Chief Justice is the first of them. Generally, the Chief Justice is the Master of Roster and plays a major role in administrative matters, but his role in appellate matters remains the same as that of other fellow judges.
