New Delhi: Explaining the reason for the exclusion of Dalit Christians and Dalit Muslims from the list of Scheduled Castes (SC), the Central Government has said that historical data shows that they (Dalit Christians and Dalit Muslims) have never experienced any backwardness or oppression. not encountered. Arguing that Dalit Christians and Dalit Muslims cannot claim the benefits accruing to the Scheduled Castes, the Ministry of Social Justice and Empowerment, in an affidavit filed in the apex court, said the Constitution (Scheduled Castes) Order of 1950 does not constitute any unconstitutionality.

The Central Government had filed this affidavit in response to a petition by the NGO Center for Public Interest Litigation (CPIL), which sought reservation and other benefits for those belonging to Dalit communities. who had converted to Islam and Christianity. Along with this, the Supreme Court said on Wednesday (November 9) that just as a strike is a weapon for employees, similarly protesting is a tool for civil institutions. The apex court made this statement while hearing a petition filed by Ravi Namboothiri. The petitioner had challenged the decision of the Kerala High Court, in which the HC had upheld the lower court's decision in November 2015 to set aside Ravi's election as a councillor.

In fact, his election to the post of councillor was annulled on the ground that he had concealed his involvement in a criminal case in his nomination and thus committed a corrupt practice. A bench of Justices S Abdul Nazeer and V Ramasubramaniam heeded that just as strikes and lockouts of workers are a weapon in the hands of the employer, similar protests are a tool for civil organisations. According to the police complaint, on September 20, 2006, Namboothiri and others gathered illegally and set up a temporary pandal to organize a sit-in in the office premises of Annamanada gram panchayat.
