Government plans to ban e-cigarettes, nicotine flavoured hookahs

New Delhi: Central government is mulling various options like bringing an ordinance to enforce a ban on the manufacture, sale and import of ENDS devices, including e-cigarettes if it fails to get a reprieve from the Delhi High Court, which had earlier stayed its order to ban such products.

The Central Drug Standards Control Organisation has written to the Drug Controllers of all the State Governments asking them not to allow sale, manufacture, distribution, trade, import or advertisement of EDDs. A single bench of the Delhi High Court had in March this year imposed an interim stay on the central government circular saying that these products are not narcotics and the authorities do not have the power to issue such orders. So, the Health Ministry is taking legal opinion.

If the Government brings an Ordinance, it will be given the shape of law by bringing a Bill in the next session of Parliament. Once the Bill is passed by Parliament, the proposed ban on such products will be legal. The Indian Council of Medical Research had recommended a complete ban on EDDs.
