Delhi High Court On Wednesday ruled on the challenge petition of former Chief Minister Om Prakash Chautala, who is serving a sentence in the teacher recruitment scam in Tihar Jail. A bench of Justice Manmohan and Justice Sangeeta Dhingra Sehgal quashed the Delhi government's decision to dismiss the application for early release, directing that the OP hear the plea of Chautala afresh. OP Chautala had filed a petition in the High Court seeking release from jail on the basis of age and disability. The court reserved the verdict on 16 November after hearing both the sides. For your information, let us tell you that in the petition filed through Advocate Amit Sahni, OP Chautala argued by quoting the notification of 18 July 2018 of the Central Government. According to the notification, if the men who have crossed the age of more than 60 years, 70 percent of Divyang have completed half of their sentence, then the state government can consider release. In the petition, Chautala said that he has reached 83 years of age and has already served a seven-year sentence in a corruption case. In the petition regarding this matter, Chautala had said that he had become 60 percent disabled in April 2013 and since the pacemaker was installed in June 2013, he has become more than 70 percent disabled. In this way they are fulfilling all the conditions of early release. In view of this, he should be released now. Opposing this, the Delhi government had said in the hearing that because it is a case of corruption and the notification of the Government of India under which Chautala is seeking relief does not apply to it. Chautala's lawyer Amit Sahni had argued that his client should get the benefit of the notification as his seven-year sentence in the corruption case has been completed. In such a situation, it is not justified to dismiss the Delhi government's demand for premature release.
