PIL filed in Supreme Court regarding guidelines on sexual harassment against transgenders

New Delhi: A petition has been filed in the country's largest court seeking directions from the Central government to make appropriate changes in the indian penal code's provisions relating to sexual harassment. The petition filed seeks to include transgender, transsexuals, eunuchs in the ambit of sexual harassment, so that such cases can be disposed of in case of any incident against them.

A PIL filed in the Apex court said that the court should direct the government to make appropriate changes and interpretations of the IPC section and provisions to deal with sexual harassment so that cases of sexual harassment of transgender, transsexuals, eunuchs can also be taken under its ambit. The petition seeks to formulate a guideline to protect the fundamental rights of the third gender. The petition said that third-gender people face sexual harassment, so they should also be given a fundamental right of protection.

The petition also somewhat challenges the constitutional validity of section (i), (ii) and (iv) of sub-section (1) of section 354A of IPC which provides for disposal of cases of sexual harassment.
