Now Article 370 Reaches Supreme Court

New Delhi: The case of the removal of Article 370 by the Central Government from Jammu and Kashmir has now reached the Supreme court in the country. Prosecutor Manohar Lal Sharma has moved the Supreme Court questioning the process adopted by the government. In his petition, Sharma termed the notification of the President's order to remove Article 370 as against the spirit of the Constitution. He has said in his petition that the amendment made by the Government to remove article 370 is unconstitutional.

In the pettition he said, Government has acted arbitrarily and unconstitutionally. This can be done after the opinion of the Constituency Assembly of Jammu and Kashmir. The petitioner demanded that the court declare the notification as unconstitutional and quash it. The repeal of Article 370, which gives special status to Jammu and Kashmir, after almost 70 years, has cleared the way. On Monday, the Rajya Sabha sealed the proposal and the Lok Sabha also approved it on Tuesday.

At the same time, Sections 370 and 35A which determines the citizenship of Jammu and Kashmir will be abolished. Despite opposition from some parties, the government has also passed a bill to divide the state of Jammu and Kashmir into Jammu and Kashmir and Ladakh to make both union territory. Ladakh will be a union territory without an assembly, while Jammu and Kashmir will also have an assembly.  

However, according to Constitutional experts, the government has not taken any unconstitutional steps. The entire process followed by the Government is in accordance with the Constitution.
