NEW DELHI: The Supreme Court has directed the Centre to formulate a comprehensive model policy on menstrual leave for women employees, urging consultations with states and stakeholders. Chief Justice D Y Chandrachud, along with Justices J B Pardiwala and Manoj Misra, emphasized that the issue requires a policy framework rather than judicial intervention.
Highlighting concerns that judicial mandates might hinder women's employability, the bench underscored the need for a government-led approach to ensure inclusivity in the workforce. "We do not want women to be excluded from employment opportunities," the bench said.
Acknowledging the multifaceted nature of state policy issues, the court permitted petitioner Rakesh Khanna and lawyer Shailendra Tripathi to approach the Ministry of Women and Child Development. They were instructed to engage with the Additional Solicitor General to propose a policy that balances the interests of all stakeholders.
The court clarified that the Centre's consultation process should not impede any steps taken by states on this matter independently. Previously, a plea for menstrual leave for women students and professionals had been disposed of, with the court advising representation to the Centre due to the policy's domain.
As discussions continue, stakeholders await the Centre's decision following consultations, marking a pivotal moment in workplace inclusivity and policy-making.
