Chennai: A disgusting and embarrassing case has come to light in Thanjavur district of Milanadu. A 15-year-old innocent girl was raped by her father and grandfather, which made her pregnant. Keeping in mind the health of the 25-week pregnant girl, the Madras High Court on Tuesday allowed her abortion. The court was hearing a petition filed by the girl's maternal aunt, who sought permission from the court for abortion. According to the petitioner, after the death of the girl's mother, her father and grandfather raped her several times. A case was registered against both the accused under the POSCO Act and arrested. Justice R Ponginappan said that according to the Medical Termination of Pregnancy Act, miscarriage beyond the 20 weeks of pregnancy is not allowed, but section 5 provides for an exception. The judge allowed the abortion citing the earlier orders of the court and the recommendations of the Medical Committee headed by the Dean of Thanjavur Medical College Hospital. The committee said that continuing the pregnancy can be dangerous for the baby's health. The court said that abortion has also been allowed keeping in view the mental and social circumstances of the victim. The judge also cited the decisions of the apex court that if there is a valid reason, the gestation of more than the prescribed time can also be dropped. The court ordered the embryo samples to be preserved until the criminal case is settled.
