23-week pregnant woman seeks permission of abortion from Delhi HC

New Delhi: Delhi High Court has issued a notice to the Kejriwal government and AIIMS on Friday on a petition filed regarding abortion of a woman's 23-week gestation and sought answers. According to this woman's petition, the fetus growing in the womb has severe malformations. A bench of Chief Justice DN Patel and Justice Prateek Jalan issued notice to the Delhi government and All India Institute of Medical Sciences (AIIMS) asking them to respond to the woman's plea.

After examining the woman, the bench has directed AIIMS to submit its report to the court by 13 July. The matter will now be heard on July 14. The woman, in a petition filed through advocate Sneha Mukherjee, has stated that the baby growing in her womb has a disease called 'spina bifida and Arnold Chiri syndrome', which causes improper spinal cord development and brain tissue.

According to the ultrasound reports, the fetus has a deformity in the brain and also has the heart-related disease. It has been said that due to these abnormalities, it is very difficult for a child to survive after birth. The petitioner said that if the pregnancy continues, the woman is likely to suffer irreparable physical and mental damage. Abortion is legally valid in India. However, legally abortion can be done only up to 20 weeks after conception.
