Chandigarh: The Punjab and Haryana High Court has made it clear in one of its decisions that if the husband's salary increases in the event of a marital dispute, then the wife is also entitled to an increase in alimony. This order has been dismissed by High Court Justice HS Madan, a petition filed by a husband. In a case of a matrimonial dispute, the Panchkula Family Court refused to intervene, stating that the wife's interim maintenance allowance of 20000 to 28000 is correct. In this case, Varun Jagota, a resident of Panchkula, challenged the order of the Panchkula Family Court in the High Court. The Panchkula Family Court has given an interim maintenance allowance of Rs. 20 thousand to Rs. 28 thousand to the wife after the husband's salary increases. The High Court made it clear that if the husband's salary has increased, the wife is also entitled to increase interim maintenance allowance. The High Court dismissed the petition.

The husband of the petitioner said in the High Court that the family court had ordered in his case on 5 March 2020 that the salary of the petitioner has increased from Rs 95 thousand to Rs 1 lakh 14 thousand a month. After all the deductions, he gets 92 thousand 175 rupees as salary, and in such a way, how was the order of giving interim alimony allowance of 28 thousand rupees. The High Court rejected the plea of the petitioner and said that the High Court can intervene in such a case if the order is against the law or is biased.

The High Court rejected the plea of the petitioner and said, 'The possibility of intervention of the High Court in the revision petition has been greatly reduced. This happens when the order is against the law or is biased. In this case, nothing of the sort appears. On one hand, while the salary of the husband has increased, on the other hand, the rent of the wife's house has also increased by Rs 1500. The family court has given its decision and has considered all the facts and the order is detailed on it. In this way, the High Court dismissed the petition, denying any relief to the petitioner.
