NEW DELHI: A man implicated in the multi-million dollar Vyapam scam case has been given temporary protection from arrest by the Supreme Court, on the condition that he cooperate with the investigation.

The Madhya Pradesh government was given notice and asked for a response to the appeal by a bench of Justices Sanjay Kishan Kaul and Aravind Kumar.

"Counsel for the petitioner submits by reference to the Special Task Force report that with regard to the petitioner's role, nothing has been discovered other than the accuser's memorandum, the investigation is complete, and a final report has been filed.

Release notification. The petitioner should not be detained in the interim but should help with any ongoing investigations, the bench ruled.

The Madhya Pradesh High Court's decision to reject Rajesh Kumar Shrivastava's request for anticipatory bail was being challenged in a case before the Supreme Court.

After receiving a complaint of anomalies in the Professional Examination Board-Vyapam's admission procedures for competitive examinations at the Bhopal police station, the Special Task Force (STF), Bhopal, began investigating the case and named Shrivastava as an accused.

The accused's attorney, Namit Saxena, contended that although the high court rejected the petition for anticipatory bail and stated that the petitioner must undergo custodial interrogation, the status report submitted by the STF indicated that the investigation was complete.

The high court denied the petitioner's request for anticipatory bail without considering the facts and circumstances of the case or the evidence that was presented in court.

"That petitioner's name appears only in the accuser's memorandum, and nothing whatsoever pertinent or substantial has been produced or discovered against him." Even the SHO of the STF Police Station made it plain in his final report that the petitioner had not been implicated in the alleged crime and that the matter should be dismissed, according to the plea.
