New Delhi: All India Muslim Personal Law Board (AIMPLB) has approached the apex court on polygamy and marriage. The AIMPLB has opposed the PIL in the Supreme Court, demanding a ban on polygamy and nikah-halala. AIMPLB, in its petition filed in the court, said that a decision has already been given on polygamy and other practices.

In its petition filed on behalf of AIMPLB, it was also stated that public interest litigation challenging the religious practice cannot be filed by a person who is not part of that religious sect. Many Muslim organizations exist, including AIMPLB, to protect Muslim interests. The apex court had on December 2 last month refused to hear the plea against the polygamy practiced in the Muslim community and against Halala. The bench headed by Chief Justice SA Bobde had said that we will look into the matter after the winter holidays. This matter has been sent to the Constitution Bench on behalf of the Supreme Court.

Ashwini Upadhyay, a BJP leader and a lawyer by profession, demanded an early hearing from the court in this case. The petition has sought to declare halala and polygemy (polygamy) as a crime like rape, while polygamy has been declared a serious crime.
