New Delhi: The Association for Democratic Reforms (ADR) has filed a petition in the Supreme court seeking setting up of an independent selection committee to appoint election commission members. The petition said there is no doubt that the objective of our framers of the Constitution to bring purity in the election process was that the election should be "free and fair". The election process should be carried out by an independent body.
The petition says that the appointment of election commission members by the Executive is based on 'Pick and Choose', which is contrary to the concept of the Constitution. A petition filed by the ADR said, democracy is an important part of the basic structure of the Constitution and it is the responsibility of the Election Commission to ensure "free and fair" elections. In such a situation, there should be no interference of the Election Commission or the Executive.
The petitioner's organisation has pleaded that the recommendations made in the 255th Report of the Law Commission should be followed. The Law Commission report said that all election commissioners should be appointed by the President on the advice of three member collegiumors or by an independent selection committee. The selection committee recommended the appointment of the PM, the leader of the opposition in the Lok Sabha and the Chief Justice of India.
