Mumbai: The Bombay High Court on Wednesday granted anticipatory bail to BJP MLA Ganesh Naik in a case of alleged rape and intimidation filed by a woman. The Court noted that there was a consensual relationship between the accused and the complainant. A single bench of Justice Anuja Prabhudesai observed that the relationship between the accused and the victim was consensual and, therefore, "prima facie it does not constitute a case of rape".
Justice Prabhudesai has said that, 'No case is made out for custodial interrogation. The application for bail cannot be rejected merely on the ground that the applicant is an MLA. The court, however, directed Naik to hand over his licensed revolver to the police within a week. In fact, the victim had claimed that Naik threatened her with his revolver. The High Court said that in the event of his arrest, Naik was entitled to bail on a surety of Rs 25,000. The High Court directed Naik, the BJP MLA from Airoli area of ​​Navi Mumbai, to appear before the concerned police station on Monday and Tuesday for questioning.
In her complaint, the 42-year-old woman claimed that she was in a 'live-in relationship' with Naik, a former Maharashtra minister, since 1995. The FIR also states that they had a physical relationship and the couple also has a child. The woman had alleged that Naik was not treating her well and did not pick up her calls. He said that there were constant disputes between them. Naik claimed that the case was registered at the behest of his political rivals.
