The High Court has refused to interfere in the PIL filed against the government action. The court said that the petitioner has failed to state that the government action has been contrary to his or the group's basic rights. This order has been given by a division bench of Justice Sudhir Aggarwal and Justice Rajiv Mishra while rejecting the petition of Lucknow advocate Rajat Gangwar.

In its statement, the High Court said that citizens have the basic right to raise their voice and protest against the government in a democracy, but it cannot be used contrary to the basic rights of others. The state government also has the right to take legal action to maintain law and order.

The petition was heard during the winter vacation. Advocate Kunal Shah, Abhinav Bhattacharya and Additional Chief Permanent Advocate of State Government Nimai Das and Permanent Advocate BP Singh Kachwaha debated the petition. The state government told the court that 1022 people from 34 districts have been arrested in the case of violence. Violence has occurred in these districts during protests against the Citizenship Amendment Act. Arson and sabotage during the demonstration. The violence has left 17 dead and hundreds injured in Aligarh, Meerut, Muzaffarnagar, Bijnor, Bulandshahr, Kanpur, Rampur, Gorakhpur, and Varanasi.
