Jodhpur: There is a provision of three years difference in the minimum age of girl and boy for marriage. A new debate has started in the High Court on the legal difference of age. The lawyer has described this difference in the PIL as discriminatory and conservative. On the same matter, a bench of Chief Justice Inderjit Mahanti and Dr. Justice PS Bhati, while accepting the petition, has issued notices to the Central Government, the State Government, and the Central Law Commission. He has sought an answer on this matter in 6 weeks.

This petitioner Abdul Mannan has said in the petition that the boy is allowed to marry till the age of 21, the same girl is considered eligible for marriage at the age of 18 years. So this is a wrong rule. There is no scientific basis behind this difference. At the minimum age, this distinction reflects orthodoxy. He argued that in addition to Articles 14, 15 and 21 of the Constitution, it is also considered against gender equality, gender justice and respect for women.
