Centre Seeks Continuance of ED Director's Tenure Till October 15, Cites FATF Review

 The Centre has approached the Supreme Court seeking the continuance of ED Director Sanjay Kumar Mishra until October 15, citing concerns that his absence during the ongoing FATF review could adversely impact India's national interests. Solicitor General Tushar Mehta informed a bench of Justices BR Gavai, Hima Kohli, and Prashant Kumar Mishra about the application seeking modification of the court's July 11 verdict.

Urging for urgent listing of the miscellaneous application, Mehta emphasized its urgency and requested a hearing by July 28 (Friday). The bench agreed to hear the matter on Thursday at 3.30 PM. Earlier, the Supreme Court had declared the repeated extensions granted to Mishra as "illegal" and stated that the Centre's orders were in "breach" of its mandate in the 2021 verdict, which indicated that the IRS officer should not be given further terms. As a result, Mishra's extended tenure was curtailed to July 31 from November.

The top court made this decision in consideration of the FATF peer review being conducted this year and to facilitate a smooth transition. Normally, Mishra would have remained in office until November 18, 2023, as per the government's notification.
