Lucknow: In a recent development related to Congress leader Rahul Gandhi's derogatory remarks about freedom fighter Veer Savarkar last year, Lucknow District and Sessions Judge Ashwini Kumar Tripathi has accepted a plea challenging the dismissal of a complaint filed against Gandhi. This decision follows an application made before ACJM Ambrish Kumar Srivastava.

The complainant, Nripendra Pandey, alleged that Rahul Gandhi intentionally made derogatory remarks about Veer Savarkar during the Maharashtra leg of his controversial Bharat Jodo Yatra. In response to this plea, the Lucknow District Judge has issued a notice to Rahul Gandhi and transferred the case to the MP/MLA court. The hearing on this matter is scheduled to commence on November 1, 2023.

This development stems from advocate Nripendra Pandey's application last year under Section 156(3) of the CrPC, requesting the registration of an FIR against Gandhi. However, the court declined to direct the police to investigate and instead registered the case as a complaint. Subsequently, the complaint was dismissed on the grounds of being outside the court's jurisdiction.

Rahul Gandhi's Derogatory Comments Against Veer Savarkar:
During the Maharashtra leg of his 'Bharat Jodo Yatra,' Rahul Gandhi launched a scathing attack on Veer Savarkar. On November 15, 2022, he alleged that the freedom fighter had accepted a pension from the British government to work against the Indian National Congress (INC).

Continuing his criticism on November 17 of the same year, Rahul Gandhi repeated his claims that Veer Savarkar assisted the British government and wrote mercy petitions "out of fear." In the Akola district of Maharashtra, he accused the Indian freedom fighter of betraying leaders like Jawaharlal Nehru, Sardar Patel, and Mahatma Gandhi.

Rahul Gandhi stated, "Veer Savarkar, in a letter written to the British, said – Sir, I beg to remain your most obedient servant" and signed it. Savarkar helped the British. He betrayed leaders like Mahatma Gandhi, Jawaharlal Nehru & Sardar Patel by signing the letter out of fear."

He continued, "While he was lodged in Andaman jail, Savarkar wrote a letter to the British pleading with them that he be pardoned and released. He took a pension from the British and worked against Congress." Rahul Gandhi further claimed, "After coming out of jail, he accepted the British proposal and joined their force. The difference between Savarkar and Birsa Munda is that he died fighting against the British when he was just 24 years old."
