Delhi HC says officials make false claims, govt should fix their accountability

New Delhi: The Delhi High Court has expressed surprise over the government making false claims and defending them. The court said that there is no accountability of the officers who do so due to a lack of fear of punishment. The High Court asked the Centre and the Delhi government to frame rules aimed at making the authorities accountable if they fail to deal with court cases.

Terming it as a matter of serious concern, the High Court has said that it prima facie believes that whenever the Government makes a false claim, it causes gross injustice to the plaintiff seeking justice. There is unnecessary pressure on the court also. Justice JR Midha said in a 31-page order, "In all these cases, the government has made false claims before this court, which is a matter of deep concern. All these cases have shaken the conscience of this court. Such false claims seem to be being made without fear of punishment, as no government official has any accountability for making false claims and the government hardly takes action against a person who makes false claims.''

The high court said that these false claims also harm the government but no action is taken against the officer concerned who makes false claims. The high court further said, "If the court finds the facts given by the authorities to be false or false, the government should consider taking action and a copy of the verdict should be placed in the ACR (Annual Confidential Report) file of the officer. This will fix the accountability of the officer for his steps in court cases.''
