In a significant development, the European Commission announced on Friday that it was reinstating a hefty fine of 376.36 million euros (equivalent to $400.26 million) against Intel. This penalty was levied due to Intel's prior and confirmed abuse of its dominant position within the computer chip market. The decision comes as a sequel to a previous judgment by the EU's General Court in 2022, which partially annulled a staggering 1.06 billion euro fine imposed on Intel back in 2009. The 2009 fine was related to Intel's alleged efforts to suppress competition from Advanced Micro Devices in the x86 central processing units (CPUs) market.

The General Court, during its deliberation in 2022, dismissed the Commission's assertion that Intel's rebate practices with computer manufacturers had negatively impacted competition. Despite this, the Commission remained resolute in its pursuit of justice.

In its latest ruling, the European Commission clarified that the re-imposed fine was now grounded in the payments Intel made to computer manufacturers between 2002 and 2006. These payments were aimed at persuading companies such as Hewlett Packard, Acer, and Lenovo to either halt or delay the release of specific products featuring competing x86 CPUs. The Court had already affirmed in the previous year that these payments unequivocally constituted an abuse of market power.

However, the earlier judgment had raised questions about the proportionality of the fine, leading to its partial annulment. This complex legal journey underscores the EU's commitment to fostering fair competition within the tech industry, ensuring that dominant players cannot employ anticompetitive tactics to stifle innovation and choice in the marketplace.
