Former Rajasthan Judicial Magistrate Eliza Gupta Writes to PM Modi and President Murmu, Accusing Colleagues of Harassment

Jaipur: Eliza Gupta, a dismissed judicial magistrate of Rajasthan, has stirred controversy by writing to the Supreme Court, President Droupadi Murmu, Prime Minister Narendra Modi, and Law Minister Arjun Ram Meghwal. Dated December 15, the letter levels serious harassment charges against judges and senior lawyers in Rajasthan. However, these charges were refuted by other lawyers who accused Gupta of arrogance, claiming the controversy arose after she filed a sedition complaint against an advocate based on a verbal spat.

In her letter, Gupta alleged feeling "disheartened" after reading a letter from another Uttar Pradesh woman judge "who was similarly harassed like me by my department, which instigated me to write this letter so that strict action is taken against the culprits." 

"I had to lose my job/service as a judge because I raised my voice against such incidents," she said.

"As a victim of circumstances, I was removed from service by stigmatic remarks that would not allow me to live peacefully with dignity in any part of the world. I was posted as ACJJM-1, Nagaur, on September 16, 2023, when advocates Peer Mohammad and Arjun Ram Kala assaulted and threatened me, used abusive language on me, and upon my appointing authority (the Governor of Rajasthan), while I was working on the dais and discharging my court duties. They hammered hands on the dais and shouted abuses," Gupta's complaint letter read.

"Due to the influence of lawyers like Peer Mohammad and Arjun Ram Kala of Nagaur, I was transferred to Jodhpur on the next working day. I was on leave, but I was called back midway and asked to come to the senior judge's chamber late at night, where I was harassed close to midnight on September 18, 2023," Gupta stated in her letter.

The former judge demanded justice and stated, "I had to lose my job/service because I initiated contempt proceedings against two undisciplined advocates and raised my voice against them. My own department did not support me and favored the accused advocates and did not let an FIR be registered."

Meanwhile, several lawyers from Nagaur claimed that Gupta misused her power and behaved badly with lawyers, insulting them and using foul language. Lawyers alleged that Gupta harassed advocates who sought justice and deliberately filed claims and dismissed civil suits to corrupt the judicial process. A lawyer claimed Gupta filed a fake sedition case because he argued with her. Lawyers submitted a detailed presentation to the association, which forwarded the report to the High Court and the district judge for investigation.
