Mumbai: Nowadays, the court has been pronouncing judgments that are shocking. Now, something similar has happened recently. In fact, marital rape has taken place in this case and within the last 7 days, different judgments of two courts in the country have come to light which is shocking. On August 6, the Kerala High Court in a judgment had said that marital rape is cruelty and could be the basis of divorce. In a similar case, the Mumbai City Additional Sessions Court today said that it is not illegal to have sex without the will of your wife.
According to reports, a Mumbai woman had told the sessions court that she was paralyzed to the waist due to her husband's coercion. The victim had also filed a dowry harassment case against her husband and in-laws. On the other hand, the accused and his family had filed an anticipatory bail application terming it as a false case which has been cleared by the court. During the hearing in the case last Thursday, Judge S J Gharat said, "The allegations of the woman do not come under legal scrutiny." At the same time, he said, 'It cannot be called illegal if a husband has sex with his wife. He has not done anything immoral.' The judge also said, "Marital rape is not a crime in India.''
On the other hand, the court has termed the woman's paralysis as very unfortunate but also said that the entire family cannot be held responsible for it and there is no need for a custodian interrogation in the matter. At the same time, the court also said, 'The woman alleged dowry harassment, but did not say what was sought in dowry?' In the same case, the victim says, "I got married in November 2020 and the husband started having a forced relationship with me a month after the wedding. In the meantime, when I went to the doctor in January after my health deteriorated, I found that I had been paralyzed in the lower back.''
