Goa: Congress to file petition against 8 rebel MLAs

PANAJI: To file disqualification petitions against 8 rebel MLAs, who joined the Bharatiya Janata Party (BJP) in September this year, the Goa opposition Congress has decided.

Amit Patkar, the president of the Goa Pradesh Congress Committee (GPCC), announced on Monday that the Speaker's office had provided him with the papers he requested under the Right to Information (RTI) Act.

"We received the documents we requested. We will immediately submit a disqualification plea against eight dissident MLAs based on these papers, the man said.

Similarly, the Goa Legislature Department has fulfilled Girish Chodankar's request for documents made in accordance with the RTI Act.

"From the wordings in the communications, it is evidence that there has not been a merger of the original political party, which is the Indian National Congress (INC), and as a result, the claim of merger to obtain the benefit of Paragraph 4 of the Tenth Schedule of the Constitution of India fails," said former advocate general and Aldona MLA Adv Carlos Alvares Ferreira. These eight defectors will eventually be declared ineligible.
Two weeks after the eight MALs joined the BJP on September 14, the leaders of the Congress submitted separate requests for the necessary paperwork.

They requested copies of the bulletin that the Legislative Assembly published on September 14 regarding the merger of the Indian National Congress (INC) Legislative Party into the BJP as well as copies of the paperwork that the INC Legislative Party submitted in order to effect the merger, which included a number of resolutions from the Congress Legislative Party (CLP).

However, according to the material obtained under the RTI Act, there isn't a resolution by the Goa Pradesh Congress Party (GPCC) in the file.

Besides, copies of the file note from the Speaker's office and the Legislative Assembly office regarding the merger have been given to the applicants.
