The Rajasthan High Court has issued notices to the Principal Education Secretary, Director of Secondary Education and Banswada District Education Officer for not granting maternity leave to the surrogate mother. In his statement, a single bench of Justice PS Bhati passed the order while hearing Priyanka Damore's plea. In the petition, advocate Ram Pratap Saini told the court that the petitioner was working as a school lecturer in Banswara. She became a mother through surrogacy. She also took advantage of 180 days of maternity leave. But the department later removed the recovery saying it was not the child's natural mother.

Challenging the case, she said she was taking care of her herself after becoming the mother of the child. In addition, both natural mothers or surrogate mothers should be given the benefit of maternity leave. The petition also said that the adoption of the child also gives maternity leave. While hearing, the Single Bench issued notices to the concerned authorities and stayed the recovery of the petitioner.
