Govt to Go Ahead with Administrative Allocation for Satellite Broadband

The government is set to move forward with the allocation of spectrum for satellite broadband without resorting to auctions, as outlined in the Telecommunications Act of 2023, disclosed two sources familiar with the matter.

This decision comes following extensive consultations within the communications ministry, one of the sources revealed. Despite the government's submission of a miscellaneous application to the Supreme Court, seeking approval for administrative allocation, it has yet to be accepted.

According to the provisions of the Telecommunications Act, certain services can be allocated outside of auction processes. The Act's first schedule lists 19 such services, including satellite broadband, technically referred to as global mobile personal communication by satellites (GMPCS), along with others like TV broadcast, direct-to-home (DTH), national long-distance calling, maritime, and in-flight connectivity services.

Reports emerged on Wednesday stating that the Supreme Court registrar declined to accept the government's miscellaneous application. The court cited the application's failure to provide reasonable grounds for consideration, also highlighting the significant time elapsed since the 2012 judgment. Additionally, the report noted that the government's submission was perceived as an attempt to challenge the court's decision under the guise of an application for review.

In 2012, the Supreme Court ruled that competitive auctions should be the standard method for distributing natural resources owned by the public. Subsequently, the government withdrew a review petition against the judgment, and a Presidential reference was made by the Union government in response to the ruling.
