Hearing in supreme court today on merger of six BSP MLAs into congress

The Supreme Court has decided to hear the petition filed for the merger of 6 MLAs of BSP with Congress in Rajasthan. A bench headed by Justice Arun Mishra said that it will hear the petition against the direction of the High Court on Tuesday along with a separate petition filed by six MLAs.

The Rajasthan High Court has refused to ban the six BSP MLAs who joined the ruling Congress in the state to act as Congress MLAs. BJP MLA Madan Dilawar has challenged this order of the High Court in the Supreme Court. Six MLAs have requested the Supreme Court in their separate petition, that they should send the petition of Dilawar pending in the High Court.

Dilawar in his petition has requested to disqualify the BSP MLA for violating the party whip. Dilawar challenged the August 6 order of the High Court bench in which his petition against the order of the single judge was disposed of. The court had refused to ban six MLAs from working as Congress MLAs. On behalf of Dilawar in the Supreme Court, senior advocate Harish Salve said that the Speaker of the Legislative Assembly accepted the merger of these MLAs into Congress last September. I had passed the order. The BSP says that it has never merged. Salve also mentioned the 6 MLA petition pending in the Supreme Court. The bench said that it will hear both the cases on Tuesday.
