Kochi: The Central High Court, while hearing a case, has made important remarks on the SC/ST Act. The court said that even a derogatory comment made online against any person belonging to SC/ST will also be treated under the SC/ST Act. The high court gave the verdict while dismissing the anticipatory bail plea of a Youtuber.

In fact, the petitioner had made derogatory remarks about a woman from the ST community in an interview, this interview was later posted on social media as well. According to the agency, the Youtuber had approached the court seeking anticipatory bail fearing arrest. The accused had contended that the victim was not present during the interview. Therefore, the provisions of the SC/ST Act are not baited. The accused also said that the comment should be treated as defamatory only if it is made in the presence of the victim.

At the same time, opposing the petition, the prosecution has contended that only a comment made in the presence of the victim will be a derogatory remark, it is inconsistent to say. If this type of interpretation is adopted in the digital age, it would be legally redundant. The victim's counsel opposed the plea, saying the accused was deliberately disrespecting the Scheduled Tribe member in public.
