KOCHI: The Kerala High Court ruled that the child of an unwed mother or a raped victim is a citizen of the country and that no one can violate any of his or her fundamental rights guaranteed by our Constitution, and that the petitioner has the right not to specify the name of the father in identity documents.

A single Bench of Justice PV Kunhikrishnan rendered a decision on a writ petition seeking to delete and remove the father's name from the birth certificate, and directed the issuing of a certificate displaying only the mother's name as a single parent. The petitioner argued that a person has the right not to include their father's name on identification documents.

According to the petition, the mother conceived her son (the petitioner) when she was a minor under unclear circumstances by an unidentified individual, and the petitioner's father's identity was listed variously in different documents. On July 19, the court heard the petition and delivered a decision.

The Court stated in its decision, "A child born to an unwed mother is also  a citizen of our country, and no one can violate any of the fundamental rights granted by our Constitution. He/she is not only the unwed mother's son/daughter, but also of this wonderful country "India." We must live in a world where there are no examples to cite for the word "bastard," and let that word remain in the dictionary pages without the possibility to provide examples to the next generation of English students."
