CHENNAI: The National Green Tribunal's Southern Bench has dismissed a review petition filed by the Tamil Nadu Generation and Distribution Firm (TANGEDCO) challenging the tribunal's decision to penalize the power company Rs 75 lakh.
A wild elephant, four boars, a common mongoose, a striped necked mongoose, three cobras, and a crow were killed in the Chungam forest division in Cherambadi forest region in Nilgiris district, purportedly due to the breakage of a Tangedco power line.
The Tangedco had not insulated the high tension wire, which resulted in the death of wild animals, according to the report. The panel found the power company liable for the deaths of the animals and imposed a fine of Rs 75 lakhs on the state forest department.
The bench dismissed Tangedco's petition appealing the ruling, saying that the review applicant's arguments could not be used as a basis for review unless they could show that there was an error visible on the face of the record. The National Green Tribunal further stated that after considering the petition, the tribunal determined that Tangedco must pay compensation based on the'strict culpability principle.'
