NEW DELHI: A 24-year-old man died 10 years ago due to the negligence of a hospital in the national capital. The Delhi State Consumer Disposal Commission has slapped a fine of Rs 25 lakh on the hospital. The case is of December 9, 2009. Swine flu was at its peak in Delhi during that time. Kailash Khandelwal, who lives in Palam, had admitted his 24-year-old son Umesh to Ayushman Hospital in Dwarka for treatment when he fell ill.

Even after Kailash Khandelwal's repeated assertion, the hospital did not test his son H1N1. Three days later, when his condition worsened, Kailash insisted on the hospital to undergo a test, after which it was discovered that the hospital lab did not have the facility to conduct the H1N1 test. Umesh's H1N1 test was carried out by a second laboratory which revealed that he had swine flu. By that time, however, Umesh's condition had worsened and he died on December 15.

The Consumer Commission in its judgment said the hospital itself was 'disabled' and failed to treat Umesh properly. The commission in its order said that if the hospital could not give Umesh the right treatment, he should not have admitted Umesh. But even after the lack of hospital facilities, Umesh was admitted and did not give proper treatment, which led to his death, so we impose a fine of Rs 25 lakh on him for this serious negligence of the hospital.
