New Delhi: An application challenging the decision of the President to reject the mercy petition of Nirbhaya gang rape and murder case Vinay Sharma was heard in the apex court today. Vinay's lawyer, who was convicted in the Nirbhaya case, came up with a new tactic to avert the execution. AP Singh said, 'Vinay Sharma's mental condition is not good, Vinay is going through Mental Trauma due to being mentally tortured, so he cannot be hanged.'

The lawyer said that the psychiatrist in the jail regularly checks Vinay and he is given medicines. The most important thing here is that according to the law, the guilty should be physically and mentally healthy at the time of hanging, he should not have any disease. In view of this law, terrorist Devendra Pal Singh Bhullar should not be hanged. He became mentally ill after being convicted by the court and hearing the hanging, due to which he could not be hanged. Finally his hanging sentence was commuted to life term by the apex court.

In Bhullar's case, he was sentenced to death in 1993 for conspiring to bomb the car of the then Youth Congress President MS Bitta in Delhi. 9 people were killed in this attack, while 25 others, including Bitta, were seriously injured. Bhullar was also hanged from the top court for this crime. The President also turned down his mercy petition in May 2011, but Bhullar's wife had appealed to the apex court to waive the hanging, basing the 8-year unreasonable delay in settling the mercy petition.
