New Delhi: National Conference (NC) leader former Jammu and Kashmir CM Omar Abdullah wants to get a divorce from his wife Payal Abdullah soon. For this, he has challenged a circular of the Delhi High Court in April last year. The Supreme Court has agreed to hear this petition of Omar Abdullah. According to the circular, in a case, both sides will have to agree to an early final hearing through video conference. A bench of Chief Justice SA Bobde, Justice AS Bopanna and Justice V Ramasubramanian issued notice to the Registrar General of the Delhi High Court seeking an answer.
Initially, senior advocate Kapil Sibal, appearing for Abdullah, said in the court that the other party in the matrimonial case is not giving its consent for a final hearing through video conference. He said that the other party has appeared in the proceedings before the trial court. The court told Sibal, 'Can we force anyone to give consent?' The next hearing in the case will now be after two weeks.
The Delhi High Court rejected Abdullah's petition challenging the circular dated 26 April 2020 on November 3 last year. Omar had argued that his marriage appeal against a 2016 order of the trial court has not been listed for final hearing since February 2017. His divorce petition was turned down by the trial court.
