New Delhi: Recently the Union Health Ministry has drafted a bill to stop violence against doctors. The ministry plans to present it in the current winter session only. But the Law and Home Ministry have said to improve some provisions of the draft bill citing ambiguities and flaws.
According to sources, the draft 'Health Services Personnel and Clinical Establishment (Prohibition of Violence and Damage to Property) Bill, 2019' provides for jail term of up to 10 years for those who attack on duty doctors and other health workers. There is a provision. During inter-ministerial deliberations, the Ministry of Home Affairs observed that as a general rule, non-bailable offences have a punishment of three years or more, but all offences in the draft bill are cognizable and non-bailable. 5 (1) provides for a minimum sentence of six months. Hence the offence should be bailable under Section 5 (1).
Home Ministry raises finger: According to the information, the Home Ministry has raised a finger on another provision of the draft bill, which states that the investigating officer will not be below the Deputy Superintendent (DSP) level. The Ministry of Home Affairs says that this provision also needs to be reconsidered as there are no more DSP or higher officers in a district. In this case, the Law Ministry has suggested to keep the investigating officer of minimum inspector level.
Provision for double damages and compensation up to five lakh rupees: According to information received from sources, it has been learned that in the draft of the bill, compensation for damage to property is double the market value and compensation to the injured from one to five lakh rupees. Provision has been made to give. On this, the Law Ministry says that there will be confusion about the market price, so a provision for certain damages can be made in it and it can be left at the discretion of the court.
