'Break Waqf Bhawan in a month...', Judge Amanullah objects to Patna High Court verdict

Patna: Orders have been passed in the High Court with a judgment of 4:1 to demolish the 4-storey 'Waqf Bhawan' being constructed near the northern part of the new building of the Patna High Court. The case had earlier been filed in the public interest on the directions of the Chief Justice of the court. A special bench of five justices heard the matter. The bench consisted of Justices Ashwin Kumar Singh, Vikas Jain, Ahsanuddin Amanullah, Rajendra Kumar Mishra, and Chakradhari Sharan Singh.

In the hearing of the case, four bench judges ruled in favor of removing the construction constructed with the High Court while Ahsanuddin Amanullah expressed his disagreement in the matter and termed the construction as just against the rules but refused to consider it illegal. At the same time, he said that the violation is not such that a complete demolition should be ordered, he proposed that a height of 10 feet violating the bye-law could be demolished to correct the irregularity. The court, while pronouncing its verdict, ordered that it be ascertained as to which officers were the officials who directed the illegal construction of the Waqf Building and which led to the loss of about Rs 14 crore to the public.

The court has declared the construction illegal under 'Bihar Building Bylaws'. State Building Construction Corporation Limited had constructed this building for Bihar State Sunni Waqf Board, which was being used by the Waqf Board as 'Musafirkhana'. The court has directed the Patna municipal corporation to demolish the building construction department if it fails to remove the construction within a month. The court also questioned how the construction was completed so soon during the covid crisis when no work was being done properly. The matter came to the notice of the court in March.
