PDP Bill addresses cross-border data flow, tax evasion, cryptos: Report

NEW DELHI: Industry stakeholders on Thursday, August 4 said the new framework for Personal Data Protection (PDP) Bill should emphasise on cross-border data flow and data localisation requirements, bringing ransomware, Blockchain-based crypto/ non-fungible token (NFT) scams and even the huge tax evasion by Chinese tech entities into its ambit.

The top organisation for the information technology sector, NASSCOM, stated that data is the foundation of "Digital India" and that the new framework can build on the lessons learned from the application of data privacy legislation around the world and stakeholder feedback on the former bill.

The operationalization of the fundamental right to privacy and the facilitation of data protection in a way that fosters trust in data-driven enterprises and permits the development of data-led services in a secure and reliable manner are the major imperatives, according to a statement from Nasscom.

The government announced that it will soon present a new, more incisive bill that fits into the full legal framework to protect the data of billions of citizens in place of the disputed Personal Data Protection (PDP) Bill 2019, which has seen 81 revisions to date.

The new PDP Bill, which would safeguard people's online privacy, is virtually finished, according to IT Minister Ashwini Vaishnaw.

The main problem, in Sajai Singh's opinion, is how realistic it is for a Bill to become the law of the land, according to partner at law firm J Sagar Associates (JSA).

"The drafting of the PDP Bill has to be updated to reflect the present reality, with ethics and AI, more advanced ransomware, crypto and NFTs giving Blockchain technology a commercial dimension, and things like that," added Singh.
