Chandigarh: The Punjab and Haryana High Court has stayed the Central Information Commission's order to provide information about complaints against judges. The high court has also sent a notice to the person who had asked the commission to provide information in this regard. But, more interesting than this decision is the process under which the High Court has heard the case.

According to the information, the Punjab and Haryana High Court itself filed a petition against the order of the Central Information Commission (CIC). Then he stayed the CIC order while hearing it himself. The court had filed a petition against the commission's order from its joint registrar. It was said in the petition that the CIC has sought information beyond its jurisdiction. Therefore, the court should stay it. Justice Mahavir Singh Sandhu, while hearing the petition, granted an interim stay on the commission's order and sent notice to the commission and the person seeking information.

In fact, Manish Vashisht, former head of the Narnaul District Bar Association, filed an RTI in August 2019. In this, he had sought details about the complaints received against the judges of the lower courts, and high court judges and the action taken against them. Manish Vashisht had appealed to the Central Information Commission after the High Court refused. The commission was then told by the high court that records of district judges could not be maintained for a long time. Also, the information sought regarding judges is not public, but private. Therefore, the information of judges cannot be given under the Right to Information Act.

The CIC while disagreeing with the high court's reply, ordered to inform the complaints and status of judges of the Punjab and Haryana High Courts, except the district courts. After the order, the Punjab and Haryana High Court filed a petition on its own and gave relief to itself while hearing it by becoming a judge.
