Rahul Gandhi's petition rejected in the remark case, 'all Modi are thieves..'

New Delhi:  The Jharkhand High Court has categorically refused to grant relief to former Congress national president Rahul Gandhi, who is facing a defamation case in connection with his "all Modi are thives" remark. The court has turned down Rahul Gandhi's plea seeking quashing of his defamation case. A defamation suit was filed against Rahul by a lawyer named Pradeep Modi of Ranchi for making objectionable remarks against the Modi community.

It is worth mentioning that, this incident took place 3 years ago in 2019. On March 2, in Ranchi and on April 13, 2019, in Kolar city of Karnataka, Rahul Gandhi made objectionable statements about the Modi surname while campaigning for the Lok Sabha elections. In fact, at Ranchi's rally, Rahul had said, "Why is Modi a thief?" Similarly, at the Karnataka rally, Rahul had said, "I have a question. Why do all thieves have Modi in their name, be it Nirav Modi, Lalit Modi or Narendra Modi? I don't know how many more such Modis will come forward.'' After this statement, Ranchi's lawyer filed a case against Rahul.

Delivering the verdict after hearing the matter, the bench of Sanjay Kumar Dwivedi said, "The right to dignity is the dimension of the right to life. It also comes under Article 21. The court said it was an accepted fact that the statement was made in Ranchi.'' In such a situation, the Modi community of Ranchi was also affected. The court further said, "The court perused the statement made on 07.06.2019 and found that the court has taken cognizance after prima facie the contents were disclosed. The court concluded that it was necessary to prove all the arguments in the case and dismissed Rahul Gandhi's plea seeking quashing of the defamation suit.''
