Rajiv Gandhi Assassination case: Nalini Sriharan to be released soon?

New Delhi: The Supreme Court on Friday adjourned till October 17 the hearing on a plea seeking the release of Nalini Sriharan, who is serving a life term in the Rajiv Gandhi assassination case. Nalini had filed a petition seeking premature release. A bench of Justices BR Gavai and BV Nagarathna could not hear the plea due to paucity of time.

On Thursday (October 13, 2022), the Tamil Nadu government supported the release of Rajiv Gandhi's killers Nalini and RP Ravichandran. The government had said that the recommendation sent by them to the Governor for the remission of sentence in 2018 was binding on the Governor. The state government filed two affidavits in the apex court stating that the cabinet had met on September 9, 2018, and the mercy petitions of the seven convicts were considered at that time. On this, a recommendation was sent to the Governor that the life sentence be relaxed.

The state government has said that in the exercise of the powers of Article 161, it had recommended to the Governor to implement it considering the decision taken by the cabinet as final. The Tamil Nadu government said that on September 11, a recommendation was sent to the Governor for the remission of life imprisonment to the seven convicts, which is still pending in his office.
