Mumbai: The Bombay High Court has said that when two mature people are in a relationship, one of them cannot later be accused of rape merely because the relationship breaks down or does not lead to marriage. Justice Bharti Dangre had given the verdict on March 29, acquitting a woman in the case of rape lodged against her ex-partner in 2016 at Versova police station.
The court has said that only one can be blamed in a relationship because, for some reason, both could not get married. In her complaint, the 26-year-old woman claimed that she had met the man through social media and had physical relations with him on the false promise of marriage. Later, the man moved the court, seeking acquittal in the case. Accepting his plea, the court said that the man and the woman had been in a relationship for 8 years.
The High Court has said that, undoubtedly, when the physical relationship between the two took place, she was an adult at that time. actions, She was at an age where it is believed she has enough maturity to understand the consequences of her actions, and according to the woman, on some occasions the relationship was consensual, but at other times it was coercive. The relationship continued for a long time, and it does not lead to the conclusion that on every occasion only the promise of marriage entered into sexual relations.
Along with this, Justice Dangre said that since the relationship had also soured, it could not be inferred that the physical relationship was against her will on every occasion. The judgement said that according to the woman, she had consented to a physical relationship not because of the promise of marriage but because she was in love with him.
