New Delhi: The Central Government has made rules for the smooth functioning of the Jammu and Kashmir administration. According to which the police will be under the direct control of the Lieutenant Governor of the Union Territory over the ACB. These rules have been issued by the Union Home Secretary Ajay Bhalla only under the Jammu and Kashmir Reorganization Act-2019.

The rule states that in case of differences of opinion between the Lt. Governor and the Council of Ministers (when it is constituted) in any case, it is the Lt. Governor who is to be sent to the Central Government for the President's decision. In case of dispute, the work is going to be done on the basis of the said decision. In the notification of the Home Department, it has been told that there will be 39 Ministries in Jammu and Kashmir in which Agriculture, School Education, Higher Education, Forestry, Election, General Administration, Home, Mining, Energy, PWD, etc. are present.

In the notification issued by the government, it has been told that the President makes the administrative orders due to the powers conferred under Section 55 of the Jammu and Kashmir Reorganization Act 2019. According to the new rules, in the case related to public order, police, ACB, the Lieutenant Governor is the one who will look after the executive work.

What will happen in the differences with the government: It has also been told in the order that when the CM is elected in the state, on his suggestion, the work of the Lt. Governor will be allocated among the ministers. One or more Ministries may be allotted to the Lieutenant Governor. The Council of Ministers formed is going to be collectively responsible for the orders and contracts issued by the ministries in the name of LG. In case of differences with the government, the Lt. Governor is going to discuss in two weeks. If the differences do not resolve, the Lt. Governor is going to send it to the Council. If no decision is taken even in 15 days, then the Lt. Governor will send the said issue to the Center for the President's decision. Work will be done on the basis of the decision taken by the President on the disputed issue. The issue of dispute between the Center and the state is going to be brought to the notice of the Lieutenant Governor and CM.
