SC dismissed petition questioning Rahul Gandhi's citizenship

New Delhi: Supreme Court dismissed the petition seeking to direct the Election Commission of India (ECI) to debar Congress President Rahul Gandhi from contesting the Lok Sabha polls after he had “voluntarily acquired British nationality.”

Dismissing the petition, CJI Ranjan Gogoi said, “we dismiss the petition. There is no merit in the petition.”

The petition was on the basis of a form in which a UK-based company reportedly mentioned Gandhi's citizenship as British. The petition sought a directive from the Supreme Court to debar Gandhi from contesting elections. 

The bench which also consisted of Justices Deepak Gupta and Sanjiv Khanna told the petitioners, "If some company in some form mentions his nationality as British, does he become a British citizen,"

The petitioners- Jai Bhagwan Goyal and Chander Prakash Tyagi had argued that Gandhi's name should be removed from the electoral roll. India does not allow dual citizenship and last month, the government had asked Gandhi to submit a factual reply regarding his citizenship.

Earlier in 2015 also, SC had dismissed a petition questioning Gandhi's citizenship and called it a 'frivolous' attempt to start an inquiry.
