Patna: The Bihar government has received a big blow from the Supreme Court in the case of Caste Census. The Supreme Court has refused to stay the order of the Patna High Court. Also asked the question, how will the Bihar government protect the privacy of the people and the data of the individuals in the matter of the survey? On this the reply was received that the responsibility of the privacy and data protection of the people lies with the Government of Bihar. Preparations for this have also been done. The caste census is different from the general census.

The Supreme Court said, the Patna High Court will hear on July 3, in which the Bihar government should present its stand. If the Patna High Court does not hold the hearing on time, the petitioner can approach the Supreme Court. The hearing will be held on July 14 after the summer vacations. At the same time, referring to one of its official letters, the Bihar government said that it will present its case in the next hearing in this regard. Bihar government had decided to conduct caste census last year. Its work started from January 2023. It was to be completed by May. But now the High Court has banned it till July 3. Six petitions were filed in the Patna High Court against Nitish government's decision to conduct caste census. 

In these petitions, there was a demand to ban the caste census. A bench of High Court Chief Justice Vinod Chandran and Justice Madhuresh Prasad stayed it till July 3. Bihar government's argument in favor of conducting caste census is that since 1951 the data of SC and ST castes is published, but the data of OBC and other castes is not available. Due to this it is difficult to estimate the exact population of OBC. In 1990, the then VP Singh government at the Center implemented the recommendation of the Second Backward Classes Commission. It is known by the name of Mandal Commission. It had estimated 52 percent of the OBC population in the country on the basis of the 1931 census. 27 percent reservation is given to OBC only on the basis of recommendation of Mandal Commission. Experts believe that the basis of reservation that SC and ST get is their population, but there is no basis for reservation of OBC.
