New Delhi: The Supreme Court has granted anticipatory bail to Teesta Setalvad, who was arrested in the Gujarat riots case. The court has said that the High Court can decide on his regular bail, but for the time being she is given anticipatory bail. The top court said that we have only considered bail in this case. None of our comments have any bearing on the merits of the case.
It is noteworthy that Teesta Setalvad challenged the orders of the Lower Court and the High Court in the apex court. While hearing the matter, the Supreme Court said that we have heard the arguments of the lawyers of Gujarat State and Teesta and learned that Teesta is in jail for more than two months and the petition is pending in the High Court. The Supreme Court said that the Gujarat government told us that the High Court should be allowed to hear the case. Where the state government has been given six weeks to respond.
The SC said that we are not going on the merits of the case and in view of the present situation, Teesta Setalvad grants bail, as the woman is in jail for two months. Secondly, the investigation agency has interrogated for 7 days, which was completed, so the petitioner should get relief. CJI UU Lalit asked whether the witnesses were ever harassed by Teesta Setalvad or whether there was any pressure on the witnesses from her side.
On this SG Mehta said that no such complaint was received. The CJI also asked Sibal if you have something to say on this. The court also asked whether anything was found during the interrogation of the woman. For how many days was the inquiry conducted? On this, the SG said that Teesta was questioned for 7 days. Teesta's lawyer Kapil Sibal told the court that this allegation is politically motivated. Today the charges are being laid in 2022 on the incident that happened in 2002.
Let us tell you that Teesta is accused of instigating the witnesses and fabricating false evidence. The apex court, during the hearing of Zakia Jafri's plea challenging the SIT report giving clean chit to the then Gujarat CM (now Prime Minister) Narendra Modi, had said that Teesta Setalvad was busy proving her selfishness. The court had also referred to the filing of false affidavits on behalf of Sanjiv Bhatt and RB Sreekumar.
