Supreme Court sends notice to Centre on petition demanding ban on political turncoats

Bhopal: The Supreme Court on Thursday agreed to investigate the petition of Madhya Pradesh Congress leader Jaya Thakur. In fact, it has demanded a ban on the legislators who resign, for the purpose of toppling a government, to contest elections for six years and take any public post. In this petition, a bench of Chief Justice SA Bobde, Justice AS Bopanna, and Justice V Ramasubramaniam issued notice to the Central Government. It is being told that the Supreme Court has sought an answer from them within four weeks.

Farmer Jaya Thakur has filed a petition through her husband's lawyer Varun Thakur. This petition stated that the defecting legislators should be denied to hold any remunerative post till the current term, so as to prevent this politics of resignation to topple the present government. Apart from this, the petition has also said that the 10th schedule of the Indian Constitution is called anti-defection law. When a member of the House is disqualified under this law introduced in 1985, he cannot be allowed to contest again for the same house for which he had a tenure of five years.

At the same time, political parties are trying to make the provision of the 10th schedule of the Constitution redundant. The petitioner also says that 'it is now seen that there is no obstacle for the Tenth Schedule defectors. To destabilize the elected governments of the state, the way for the legislators to resign is moving fast and the culprits are not even disqualified.
