State Government can establish State Human Rights Commission anywhere in the State : High Court

Amaravati : The High Court clarified that the State Government has the prerogative to establish State Human Rights Commission (HRC) anywhere in the State. Hearing a petition filed against HRC location, the High Court observed that HRC should be established at a particular place in the state. The High Court recalled that it was clearly stated that a Rights Commission should be constituted in our territory and not in Telangana. The State Government has informed the High Court that the State Cabinet has decided to set up an HRC at Kurnool. On behalf of the state government, Advocate General (AG) S Sriram informed that the notification given in 2017 for setting up HRC in Amaravati will be amended and the latest notification will be given for setting up in Kurnool.

He said the HRC chairman and members had inspected two campuses in Kurnool to set up HRC and were looking for a new campus as they were not suitable. He asked the court to adjourn the hearing for a month to see the progress of HRC formation. The High Court agreed and adjourned the hearing till September 27. A bench of Chief Justice (CJ) Justice Arup Kumar Goswami and Justice Naina Jayasuriya passed the order on Thursday.

It is learned that Malleswara Rao, Joint Secretary, AP Civil Rights Association, has filed a Public Interest Litigation (PIL) in the High Court alleging that the presence of AP HRC office in Telangana is causing inconvenience to the people. The court, which has heard this matter many times, recently held another hearing on Thursday. The petitioner's counsel Pothuri Suresh Kumar submitted that setting up of HRC in Kurnool would be a burden. However, the court rejected this argument.
