New Delhi:The Delhi High Court has rejected bjp's Rajya Sabha MP Subramanian Swamy's plea seeking quashing of Air India's disinvestment process and stay ing the approval granted by the authorities. In fact, Swamy had argued that the bidding process was unconstitutional, malicious and corrupt and that the process was rigged in favour of Tata Sons. He had also alleged that the other bidder was a group led by the owner of SpiceJet.

Swamy had said that there was a insolvency process going on in the Madras High Court which had passed an order against SpiceJet and hence he did not have the right to bid. Solicitor General Tushar Mehta, appearing for the Central government, had told the court that disinvestment was a policy decision taken by the government in view of the loss to national aviation. He had said that nothing was secret regarding the deal and the issue cannot be considered by the court under Article 226.

Senior advocate Harish Salve, appearing for Tata, had said that 100 per cent of successful bidders are Indian companies and there is no basis for corruption allegations. He had said that since 2017, the Government has been facing difficulties in selling the airline. There is nothing in this petition. No concrete information has been given.
