'Built Mosque by taking land in name of university..,' now SC gave its verdict on Azam Khan's Jauhar Trust

Lucknow: The Supreme Court on Monday (April 18, 2022) stayed the withdrawal of land allotted to Mohammad Ali Jauhar University in Rampur, Uttar Pradesh. The interim order was passed by the Supreme Court on a petition filed by Maulana Mohammad Ali Jauhar Trust. Let us know that, senior Samajwadi Party (SP) leader Azam Khan is the chairman of this trust. The plea had challenged the Allahabad High Court's decision which refused to interfere in the administrative process of taking back the land allotted to the university.

In fact, Azam Khan's trust is accused of constructing a mosque and other unauthorised construction on the land allotted to the university. A bench of Justices Ajay Rastogi and CT Ravikumar has now passed an interim order in the matter. The next hearing of the case will be held in August. Earlier, the Allahabad High Court had flatly refused to interfere with the UP government's decision to take control of the remaining land except for 12.5 acres.

What the High Court said:-

About 471 acres of land were acquired for the construction of the university. The district administration had said that only 12.50 acres of land would remain in the possession of the trust. Azam Khan's Jauhar Trust appealed against the verdict in the High Court. But the high court ruled that the order of ADM finance to vest in the state the additional 12.50 acres of land acquired by the Maulana Mohammad Ali Jauhar Trust Rampur was correct. The court had turned down the trust's plea challenging the validity of the SDM's report and the ADM's order.  

The high court had said that the scheduled caste (SC) land was illegally taken without the permission of the DM. The mosque was constructed instead of construction for educational purposes in violation of the acquisition conditions. The public use of the Gram Sabha, the Chak Road land and the government land on the banks of the river were taken away. The farmers were forcibly forced to get bail, in which 26 farmers lodged complaints against Azam Khan, former minister and chairman of the trust. The university was to be constructed in five years, the annual report of which was not given. Cannot interfere with the order to vest the land in the State on grounds of violation of legal provisions and conditions.
