SC approves oath of Karnataka HC Additional Judge, dismisses petition for stay

New Delhi: The Supreme Court of the country has approved the swearing-in of the Additional Judge of Karnataka High Court on Monday. The Supreme Court dismissed a petition filed in this regard during a special hearing at 10 am. In fact, Principal District and Sessions Judge RKGMM Mahaswamy of Shivamoga District in Karnataka had filed an application in the apex court and appealed to the District Court Judge C Padmaraj Nemachandra Desai to be sworn in as Additional Judge in the High Court.

It is noteworthy that Desai has been appointed as Additional Judge for a period of two years. Mahaswamy had filed a petition declaring Desai's appointment as Additional Judge unconstitutional. A warrant for the appointment of Desai has also been issued by President Ram Nath Kovind. The time of swearing in the morning of May 4 at half past ten was also fixed. Mahaswami Ji argued that Desai has been appointed as Additional Judge of the High Court, ignoring the seniority order.

Mahaswamy Ji said that this was a violation of the authority of him and many other judicial officers. Judge Deepak Gupta and Judge Anirudh Bose rejected the petition of Mahaswami ji saying that despite being so senior in the judiciary, he came to the Supreme Court for so long. Now even under Article 32, with 15 minutes left in the swearing-in, it will not be appropriate to stop in any way. After this, Desai also took the oath at the right time.
