Mumbai blast case: Will Abu Salem be released? SC's big order

New Delhi: The Supreme Court on Monday delivered a major verdict on the release of gangster Abu Salem from jail. The Supreme Court has said that Abu Salem will be released only on completion of his 25-year sentence in the 1993 Mumbai bomb blast case. At the same time, the top court also said that the central government is bound to honour its commitment to Portugal.

Salem, in his petition, had said that his sentence cannot be extended beyond 25 years, as assured by India in 2002 at the time of his extradition to Portugal. A bench of Justices AK Kaul and M M Sundress said the Centre is bound to advise the President to exercise his powers under Article 72 of the Constitution. The supreme court said, "Necessary documents should be forwarded within a month of completion of the 25-year sentence. In fact, the government itself can exercise the powers conferred under the CRPC within a month of completion of the 25-year sentence.''

On February 25, 2015, a special TADA court had sentenced Salem to life imprisonment in another case. The sentence was awarded in the 1995 murder case of Pradeep Jain, a Mumbai-based builder, and his driver, Mehdi Hasan. Salem is also guilty in the 1993 Mumbai bomb blasts case. Salem was extradited to India on November 11, 2005, following a legal battle from Portugal.
