SC seeks response from Centre on plea of 'Everybody should get same maintenance allowance'

New Delhi: The Supreme Court has asked the Centre to clear its stand on a petition on Wednesday urging maintenance and alimony in marital disputes without discriminating on the basis of "gender and religion". A bench headed by Chief Justice SA Bobde has sent a notice to the Union Ministry of Home Affairs, Law and Justice and the Ministry of Women and Child Development asking them to respond to a petition filed by BJP leader and advocate Ashwani Kumar Dubey.

The bench, also comprising Justices AS Bopanna and V Ramasubramanian, heard senior advocate Meenakshi Arora on behalf of Ashwini Upadhyay and said, "We are issuing notice with great caution." The plea seeks a direction to the government to take appropriate steps to remove the prevailing anomalies in the grounds of maintenance and alimony and make them uniform for all citizens without discrimination on the basis of race, caste, sex or place of birth.

The petition said that despite having clear provisions in the constitution, the central government has failed to give alimony to all citizens without any discrimination of gender, religion. The petition says that the central government should focus on this as soon as possible. It has been said in the petition that now the government needs to take effective steps by paying attention to this so that no person has to face such problems in the coming time.
